LETTER OF DEMAND SENT TO MS. ALISON MCELWEE BREACH OF PET ADOPTION AGREEMENT
Singapore, 1 November 2013 A Letter of Demand has been sent to Ms. Alison McElwee, who had adopted Tammy, a local cross breed puppy and subsequently euthanised her. Ms. McElwee had adopted Tammy from Ms. Ada Ong and signed a Pet Adoption Agreement with her.
I have consulted my lawyers and they have informed me that I have a good case against Alison. I have decided to pursue this matter, to raise public awareness towards animal welfare. My lawyers have, on my behalf, sent a letter of demand to Alison. The relevant facts and events in this matter have been set out in the letter of demand said Ms. Ada Ong.
ACRES is supporting Ms. Ong in this matter. It is important that Tammy did not die in vain and that we speak up for the voiceless. ACRES will provide Ms. Ong with all the support she needs to pursue this matter said Mr. Louis Ng, Chief Executive of ACRES.
Claim by Ada against Alison Key Points
1. Alison approached Ada to adopt Tammy sometime in May this year. Alison signed a Pet Adoption agreement. Alison was required to return Tammy to Ada if Tammy was no longer wanted.
2. Tammy settled in well, according to Alison, and also got along with her family. A trainer, to whom Tammy was sent at least 3 times, independently confirmed this.
3. In October this year, Alison claimed that Tammy was aggressive. She did not tell Ada. However, Ada found out about this, and she immediately contacted Alison. Ada told Alison that she would take Tammy back. Ada agreed. They discussed an interim boarding arrangement for Tammy and the costs associated with that.
4. Subsequent to that, Ada made several attempts to contact Alison. She did so to arrange a time to take Tammy back. After several attempts to contact her, Alison then responded. She told Ada that Tammy had already been re-homed. She also told Tammy that the new owners would not appreciate having Ada visit them and hence did not want to inform Ada of Tammy’s new home.
5. In fact, the above points made by Alison were all lies. The truth is, by that time, Alison had already put Tammy down. Yet, Alison repeatedly lied to Ada that Tammy had been re-homed. The truth surfaced only when the police asked Alison to confirm the facts.
6. Alison’s failure to return Tammy to Ada is a clear breach of the Pet Adoption Agreement.
